These Terms of Use ("Terms") are a legal agreement between you and Ace ("Ace", "we", "us", or "our") governing your use of the Ace mobile game and related services (the "App"). By downloading or using the App, you agree to these Terms. If you don't agree, please don't use the App.
1. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App for your own non-commercial entertainment, subject to these Terms and the rules of the app store you downloaded it from.
2. Eligibility
You may use the App only if you can form a binding contract with us and are not barred from doing so under applicable law. If you are a minor, you may use the App only with the involvement and consent of a parent or guardian. We ask for your year of birth to apply appropriate privacy and advertising protections, as described in our Privacy Policy.
3. Virtual items & currency
- The App may include virtual currency (such as coins) and virtual items (such as power-ups and gear). These have no real-world monetary value, are not redeemable for cash, and cannot be sold or transferred.
- You receive a limited license to use virtual items within the App; you do not own them.
- Any purchases are processed by the app store (e.g., Apple) under its terms. All purchases are final and non-refundable except as required by law or the app store's policies.
- We may modify, manage, or discontinue virtual items or currency at any time, and they are forfeited if your access to the App ends.
4. Advertising
The App is supported in part by advertising, including optional rewarded ads you may choose to watch in exchange for in-game benefits. By using the App you understand that ads will be shown in accordance with our Privacy Policy and your consent choices.
5. Your created content
Ace lets you design holes and publish them for other players ("User Content"). You keep ownership of your User Content, but by publishing it you grant us a worldwide, royalty-free, sublicensable license to host, store, display, reproduce, and distribute it within the App and related services so others can play it.
You are responsible for what you publish, and you represent that it does not infringe anyone's rights or violate any law. You agree not to publish User Content (including hole names) that is unlawful, offensive, harassing, hateful, sexually explicit, deceptive, or that infringes intellectual-property or privacy rights. We may review, moderate, refuse, or remove any User Content, and suspend publishing privileges, at our discretion.
6. Acceptable use
When using the App, you agree not to:
- Cheat, exploit bugs, manipulate scores or leaderboards, or use bots or unauthorized automation;
- Harass, abuse, or harm other players in multiplayer or social features;
- Reverse engineer, decompile, or attempt to extract source code, except where this restriction is prohibited by law;
- Interfere with, disrupt, or place undue load on the App or its servers;
- Use the App for any unlawful purpose or in violation of these Terms.
7. Intellectual property
The App and all related content, graphics, courses, code, names, and logos (other than your User Content) are owned by us or our licensors and are protected by intellectual-property laws. Except for the license granted above, no rights are transferred to you.
8. Disclaimers
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the past twelve months or USD $20. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Termination
You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms or to protect the App or other players. Sections that by their nature should survive termination (such as ownership, disclaimers, and limitations of liability) will survive.
11. Apple App Store terms
If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and us, not Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to provide support or maintenance for the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use must also comply with the Apple Media Services Terms and the standard Licensed Application End User License Agreement.
12. Governing law
These Terms are governed by the laws of the United States and the state in which the developer of Ace resides, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located there, unless applicable consumer-protection law provides otherwise.
13. Changes to these Terms
We may update these Terms from time to time. We'll revise the "Last updated" date above, and continued use of the App after changes take effect means you accept the updated Terms.
